tl;dr Window company wants me to pay for windows that were made without consulting me first.Details: I live in California in the Alhambra area and recently signed a contract with a remodeling company regarding the buying of windows. The company was giving me a "free" estimate which ended up not being so free. The company gave me very misleading information and totally wrong information. During the estimate process we had an understanding that I would place the order after I had the city's approval and licensure for my home project. They continued their "free estimation" for hours of my time. When they sent a window technician to take the measurements for the windows, he was tardy in his coming and when he did arrive, I was not at home. Instead of speaking to me, he spoke to my son and my father who had no idea whatsoever what I wanted to do in terms of the windows. After this occurred, the company went ahead and made the windows anyway saying I'd have to pay for them when they did not even know what I wanted.

You need to read the contract in detail to determine if it was not honored and can be broken. Doesn't matter what you or they said. All that matters is what's written in the contract which you signed and obviously did not read. Good luck.

First you need to contact a lawyer. Someone that is a specialist in contract law. Second you should contact your local BBB and the state atty General and see if any other complaints have been made about the company. Also file a formal complaint with the company. Usually the BBB and the Atty General get the ball rolling better then anyone and if they are using unethical or illegal business practices they may be out of business soon.

You do not have to pay unless you signed in writing that you wanted the work done. This is a common scam and they wont push if you tell them u checked with a lawyer and will report them.

I would suggest consulting a lawyer. However, I will say most contracts for this type of work do include a clause related to permitting; some have a release if you are unable to obtain the necessary permits. Again play it safe and check with a lawyer in your local area.

Look your contract over carefully and compare what is in your contract with the link below. See if you can find a flaw in their contract. Also check for vagueness, if vague you may have that in your favor.

What you signed is what counts, not what the salesman told you verbally. If you're still in the "cooling off period" limit for the contract, you might be able to get out of it, but that's usually only around 3 days so you're probably past that.You don't sign contracts for free estimates. Didn't you read what you were signing?
