Me and my husband have been married 4 years.We have 2 small children,a 2 and 4 year old.We have had problems since day 1,he has been very emotionally abusive,with a horrible anger and drinking problem,but in complete denial.So He left about a week ago never returning,and we currently live with my parents cause our rental was foreclosed.So,he has basically told me he doesnt have to pay me a dime that all his money his his since hes the one that works.I have been a stay at home mom at his own request.He owns a auto detailing business and says the court cant prove how much he makes cause he claims less on his tax and gets mostly cash.he has several bank accounts that i dont know of and dont know how much is in any of them.He also has one savings account with 14000 we saved by selling our car and getting "cash for keys" from our foreclsed place.Which he also states he will not give up and says it will be gone before we go to court,in fact he bought a brand new car today.whhile my parents are pretty much being forced to pay for his kids.He also was trying to buy a house and took all his documents and proof.Is their any way i can aquire or request copies from our realtor?And is their anyway i can prove all this stuff in court?Also,today he tricked me into seeing our kids,and left with my son,and is refusing to return him.I called the police and they said theres nothing i can do til we go to court,i know he is safe but,I basically want to know my rights and how to start with this whole process of legal action.Annd he says the court will probally not award me the kids based on the fact i live with my parents and have no job.Despite me being a excellent mom,can this be possible??? Please help!!! If any women has been through this,I need advice....Also,with no income i cant afford a lawyer,and he is gonna use some savings for an attorney,will this affect me in court?

The only thing I can help you with is telling you that he CANT take full custody of the kids.. Not because you live with your parents and dont have a job. They will grant shared custody but make sure you mention the drinking problem in court.

Be sure you write all that stuff down, accounts and details, etc. so you can take it with you to get some legal help and they know what they're up against. Your soon to be ex sounds like a real ass. Contact your local child services agency. They will help set up child support payments, visitation, etc. He legally owes child support. If he does not pay it voluntarily the govt. can make him by putting a lien on propoerty or business, garnish his wages, income taxes, and his social security check when he is old. Use some of the savings for your lawyer too.
